As per the reports, the resignation is perceived to be a result of an attempt to prevent Justice Patel from becoming the acting chief justice of Karnataka. Jayant Patel has resigned from service, reportedly protesting his non-elevation as the Chief Justice of any High Court, despite his seniority.

Jayant M Patel was appointed to the Karnataka High Court on February 13, 2016. After serving as the acting chief justice of the Gujarat High Court from August 13, 2015, to February 2016. He grabbed the headlines when he ordered CBI to probe in Ishrat Jahan murder case. The Ishrat Jahan encounter case is an ongoing criminal case in the Gujarat state of India. David Headley, who conspired with the Lashkar-e-Taiba in plotting the 2008 Mumbai attacks revealed in an FBI interrogation. He said that Ishrat Jahan was a “Fidayeen” (sacrificial aspirant) who was targeting the Chief Minister of Gujarat, Mr Narendra Modi. She was working for the Lashkar-e-Taiba Terrorist Group.
