While all eyes were on the presidential race since last few days, California was reaffirming the right of porn performers and producers to decide whether condoms are used in the films they create by voting “No” on Proposition 60.

As President-elect Donald Trump shocked America and the world with his election victory, porn stars celebrated a big win Wednesday, after California voters largely rejected a measure requiring the use of condoms during adult film production in the state.

The controversial measure would have mandated the use of condoms whenever performers actually engage in vaginal or anal penetration by a penis.

Proposition 60 was portrayed as a workplace health and safety measure — albeit an unusual one — that critics said would have chased the vast adult-film industry out of state.

With 96% of the vote counted, the proposition was defeated by a 53.9% to 46.1% margin.

Supporters of the measure argued that it would reduce of the risk of STI transmission on set, but members of the adult entertainment industry united to testify that it would force production underground as filmmakers dodged the requirement, thereby making production less regulated and less safe.

What’s more, the proposition would have given any state resident the power to sue porn producers and purveyors if the citizen ever saw (or reported that they saw) an instance in which a condom was not used during a shoot, which members of the industry argued would out them at risk.

“This was a tremendous victory, not only for adult performers, but for science over stigma, and facts over fear,” said Michael Stabile, a spokesman for the No On Proposition 60 campaign, in an official statement.
